Public Consultation on the Proposed New Regulation Governing the Design, Construction, and Operation of Tailings Storage Facilities

On July 5, 2024, Exempt Resolution No. 1706, 2024, from the Ministry of Mining, was published in the Official Gazette, subjecting the proposal for a new Regulation governing the design, construction, and operation of tailings storage projects to public consultation. This new Regulation will replace the current Supreme Decree No. 248, 2006, from the Ministry of Mining.

The proposed new Regulation aims to address the current challenges in managing tailings storage facilities, pursuing the following objectives:

  1. Adapting the current regulations to the standards governing tailings storage facility engineering at the international level;
  2. Considering advances in tailings engineering, especially related to new methods of tailings disposal, and national and international experience regarding failure studies;
  3. Setting rules for projects that include the extraction of tailings from existing tailings deposits; and,
  4. Establishing clear requirements that provide users with tools to present better tailings projects.

The public consultation period is 25 business days, from July 8 to August 12, 2024.
