On January 7, 2026, Supreme Decree No. 30 of 2024 of the Ministry of the Environment was published in the Official Gazette, approving the regulations implementing Law No. 21,368, which governs the provision of single-use plastics and plastic bottles (the “Single-Use Plastics Law” or “SUP Law”).
En términos generales, el reglamento regula lo siguiente:
- • Minimum percentage of plastic collected and recycled domestically that disposable plastic bottles must contain, as well as the processes for verification and certification of their composition and the applicable labeling requirements.
- El porcentaje mínimo de plástico recolectado y reciclado en el país que deben contener las botellas plásticas desechables, los procesos de verificación y certificación de su composición, así como las exigencias de rotulado.
- • Obligation for beverage retailers to offer products in returnable bottles, establishing that, in the case of supermarkets, at least 30% of the returnable bottles available for sale on display must be returnable bottles.
It should be noted that the regulations entered into force on January 7, 2026, upon their publication in the Official Gazette. However, the certifications established in the regulations and the labeling requirements applicable to certified plastic products are subject to deferred entry into force, in accordance with the transitional provisions thereof.
Additionally, it is important to consider that in December 2025 an amendment to the SUP Law was approved in order to authorize the provision of single-use products made from recyclable or reusable materials (Bill No. 17,547-12). Although its enactment and publication are still pending, such amendment provides that the regulations will enter into force six months from their publication in the Official Gazette.
