On January 14, 2026, Supreme Decree No. 29 of 2024 of the Ministry of Health was published in the Official Gazette, approving the sanitary regulation governing the reception and storage of waste from priority products (the “Regulation”), in accordance with the provisions of Law No. 20,920 (the “REP Law”).
Dentro de los aspectos relevantes del Reglamento, corresponde destacar lo siguiente:
- Reception and storage facilities. The Regulation establishes the conditions and requirements applicable to the reception and storage of waste from priority products, distinguishing between Green Points, Clean Points, and Collection Centers. It also regulates Collection Campaigns.
- Collection and transportation. It sets forth the requirements and obligations applicable to the collection and transportation of waste from priority products.
- Simplified sanitary procedure. It regulates the procedure for obtaining sanitary authorization for reception and storage facilities, as well as for Collection Campaigns, which will be processed before the respective Regional Health Authority (Seremi de Salud).
- Oversight and enforcement. Oversight and enforcement of compliance with the provisions of the Regulation will be carried out by the corresponding Regional Health Authority (Seremi de Salud).
The Regulation will enter into force six months after its publication in the Official Gazette, that is, as of July 14, 2026. Notwithstanding the foregoing, transitional provisions are established to allow existing facilities and their operators to gradually adapt their operations to the new sanitary standard.
